Terms of Use — Cattle Market Pulse
Effective date: August 17, 2026
These Terms of Use ("Terms") are a legal agreement between you and Kwabu LLC, a Texas limited liability company ("Kwabu," "we," "us"), covering the Cattle Market Pulse iOS app, the website at cattlemarketpulse.com, and everything we serve through them (together, the "Service").
By downloading, opening, or using the Service, you agree to these Terms. If you don't agree, don't use it.
Our Privacy Policy explains what we collect and is part of these Terms.
The short version
This is the plain-English summary. The numbered sections below are what actually governs — if the two ever conflict, the sections win.
- Use the Service for your own cattle business. Don't scrape it, resell the data, or work around limits.
- Every number here is informational. We work hard to be accurate, but market data, AI answers, and calculator results are not advice, not a quote, and not a guarantee. Check anything you're about to bet money on.
- We are not an insurance agent. LRP figures are reference numbers from USDA's published files. Only an RMA-authorized agent can sell you a policy or quote one.
- Pro is an auto-renewing subscription billed by Apple. Cancel anytime in your Apple Account settings; Apple handles refunds, not us.
- We're a small company. Our liability is limited, as spelled out in §19.
1. Who may use the Service
You must be at least 13 years old. If you are under 18, you may use the Service only with the involvement of a parent or guardian, and only they may make purchases. Purchases require an Apple Account, which has its own age requirements set by Apple.
If you use the Service for a business (a ranch, feedyard, order-buying operation, lender, or similar), you represent that you're authorized to accept these Terms on that business's behalf, and "you" means both you and that business.
2. Your license to use the app
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of the app on Apple-branded devices that you own or control, and to use the website, in each case for your own personal or internal business purposes. This license is granted to you and not to anyone else, and it's governed by the Usage Rules in Apple's Media Services Terms and Conditions, including as those rules apply to Family Sharing.
We keep every right we don't expressly grant here.
3. What you may not do
Don't:
- Scrape, crawl, bulk-download, or systematically extract data from the Service, or access it with any automated tool, script, bot, or AI agent, except a search engine obeying our robots.txt.
- Resell, republish, redistribute, or sublicense the data, insights, charts, or analysis we produce, or use them to build a competing product or data feed. (Our compilations and derived analysis are ours — see §10. The underlying public USDA reports are public; go get them from USDA.)
- Work around limits — rate limits, daily Ask caps, the paywall, entitlement checks, or any other technical restriction.
- Reverse-engineer, decompile, or disassemble the app, or attempt to extract our prompts, models, or source code, except where that restriction is prohibited by law.
- Attack or overload the Service — no denial-of-service, no probing for vulnerabilities without our written permission, no malware, no unauthorized access to another user's data or to any part of our systems.
- Misrepresent our output — don't present our figures as official USDA data, as a licensed insurance quote, or as endorsed by USDA, CME Group, Apple, or any auction market.
- Use the Service unlawfully, including in violation of trade, export, or sanctions laws.
If you're doing research, journalism, or anything else that needs bulk data, email us — the answer is often yes with a little coordination.
4. Your content
You own what you type. Herd entries, notes, calculator inputs, and the questions you ask stay yours. You give us a worldwide, royalty-free license to store, process, and transmit that content strictly to operate the Service for you — for example, saving your herd so it's there tomorrow, or sending your Ask question to our AI provider so it can be answered. That's the whole purpose of the license, and it ends when you delete the content or ask us to.
You're responsible for what you enter, and you agree not to enter anything unlawful or anything you don't have the right to share. Please don't enter sensitive personal information — the Service doesn't need it.
Feedback. If you send us ideas or bug reports, we can use them freely without owing you anything. (Thank you — please keep sending them.)
5. Accounts and your device
The Service has no accounts or passwords. Your data is tied to an anonymous identifier stored on your device. That means anyone with access to your unlocked device can see and change your data, and it means we generally cannot tell one person from another. Keep your device secure. See the Privacy Policy for how to have your data deleted.
6. Notifications
If you turn on alerts, we'll send push notifications about the markets and reports you subscribed to. We hold notifications during quiet hours where you've enabled that. We don't guarantee delivery or timing — push notifications depend on Apple's service, your network, and your device settings, and any of them can drop or delay a message. Don't rely on a notification as your only way of learning something time-sensitive. You can turn alerts off at any time in Settings.
7. Free features and changes to the Service
We're actively building this product. We may add, change, or remove features, move a feature between the free and paid tiers, or discontinue part of the Service. If we make a change that materially reduces what an active paid subscription includes, we'll tell you before it takes effect, and you can cancel — see §9.
8. Availability
We aim to keep the Service up and the data fresh, but we don't promise either. Data sources publish on their own schedule and occasionally publish late, publish corrections, or don't publish at all; our systems can also have outages or bugs. The Service is provided as described in §18.
9. Cattle Market Pulse Pro (subscriptions)
Some features are part of Cattle Market Pulse Pro, an auto-renewing subscription sold through the App Store. If and when you purchase one:
- What it costs and how long it lasts is shown on the purchase screen inside the app before you buy — the subscription title, the length of each period, and the price for that period. That screen governs; we deliberately don't restate prices here, because they can change.
- Payment is charged to your Apple Account when you confirm the purchase.
- It renews automatically. Your subscription renews for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Apple charges the renewal within the 24 hours before the current period ends.
- You manage it in Apple, not in our app. Go to your Apple Account settings to view, change, or cancel a subscription, or to turn off auto-renew. Deleting the app does not cancel a subscription.
- Free trials. If we offer a free trial, it starts when you sign up and converts to a paid subscription at the end unless you cancel first. Trial length and any eligibility limits (for example, one trial per Apple Account) are shown on the purchase screen. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
- Price changes. If we change the price, Apple will notify you and, where Apple's rules require it, ask for your consent before charging the new price. If you don't agree, cancel before the next renewal.
- Refunds are handled by Apple, under the Apple Media Services Terms and Conditions. We can't issue, process, or promise a refund for an App Store purchase. Except where the law requires otherwise, payments are non-refundable and we don't prorate partial periods.
- Restoring purchases. If you reinstall the app or move to a new device, use "Restore Purchases" to re-link your subscription.
- Cancellation stops future renewals. You keep Pro access through the end of the period you already paid for.
10. Our intellectual property
The Service — the app, the website, our software, design, text, charts, the "takeaway" insights, comparisons, rankings, indexes, and every other analysis we compute — is owned by Kwabu LLC and protected by copyright and other laws.
The underlying government data is not ours: USDA Agricultural Marketing Service reports and USDA Risk Management Agency actuarial files are US government works. Our selection, arrangement, normalization, and analysis of that data is ours, and so is everything we compute from it. Futures and index data is licensed to us by our providers, and your license to use the Service does not include any right to redistribute it.
"Cattle Market Pulse" and our logo are our trademarks. Don't use them without permission.
11. Where the numbers come from, and what that means
- Auction, direct, slaughter, and boxed-beef data comes from USDA AMS Livestock Market News, plus reports published directly by participating auction markets.
- Futures and index data is licensed from our market-data providers and is delayed, end-of-day settlement data — not real-time quotes, and not for trading purposes.
- LRP figures come from the USDA Risk Management Agency's published daily actuarial files.
We ingest this data automatically. Sources publish corrections, republish files, and occasionally publish errors, and our parsing can be wrong too. Where our figure disagrees with the official published source, the official source is correct. We link to it from the report so you can check — and we'd genuinely like to hear about any discrepancy.
We are not affiliated with, endorsed by, or sponsored by the United States Department of Agriculture, CME Group, Apple, or any auction market, sale barn, or livestock exchange whose data appears in the Service.
12. Not financial, trading, or professional advice
Everything in the Service is for general informational purposes only. Nothing in it is — or should be treated as — investment advice, trading advice, a recommendation to buy or sell anything, tax advice, accounting advice, legal advice, veterinary advice, or a solicitation of any kind. We are not a broker, dealer, futures commission merchant, commodity trading advisor, or investment adviser, and we are not registered with the CFTC, the NFA, the SEC, or any state securities regulator.
Calculator outputs — breakeven, profit/loss, haul cost, slide, auction, gestation, LRP — are arithmetic performed on the numbers you entered plus the market data described above. They are estimates. They can't know your actual costs, your shrink, your death loss, your basis, your contract terms, or what the market will do tomorrow.
Cattle marketing involves substantial risk of loss. Past prices do not predict future prices. Decisions you make using the Service are yours alone, and you make them at your own risk. Talk to your own advisors before acting on anything here.
13. Livestock Risk Protection (LRP) figures
This one matters, so we'll say it plainly:
- Kwabu LLC is not an insurance agency, insurance agent, or broker, and nothing in the Service is an offer to sell insurance or a quote for insurance.
- LRP is a federal crop insurance product administered by the USDA Risk Management Agency and sold only by RMA-authorized livestock insurance agents. To buy coverage, or to get a real quote, you must go through one.
- The rates, coverage prices, expected ending values, and subsidy factors we display are reproduced from RMA's published daily files for reference only. They change daily, are subject to RMA correction and re-release, and may be superseded by the time you look at them.
- Premium, subsidy, and indemnity figures our calculator produces are illustrative estimates, not the amounts you would actually be charged or paid. Your actual coverage, premium, and any indemnity are determined solely by RMA, your insurance provider, and the terms of the policy you sign — the policy governs, not us.
14. Ask, and other AI-generated content
Ask uses a large language model to turn a plain-English question into an answer built from data in our database. It is a convenience feature, and you should treat it like one.
- AI answers can be wrong. They can misread a question, mix up two markets, summarize a thin sale as if it were representative, or state something confidently that isn't true. We've built guardrails and we keep tightening them, but we do not warrant that any answer is accurate, complete, or current.
- Verify before you act. Every answer is built from reports you can open yourself. If a number matters, go look at the report.
- Answers are not advice of any kind — see §12 and §13, which apply fully to anything Ask says.
- Your question and the data used to answer it are sent to our AI provider. See the Privacy Policy for details, and don't type anything sensitive.
- Ask is subject to daily usage limits and fair-use enforcement. Don't use it to bulk-extract our data, to generate abusive or unlawful content, or to attack the underlying model.
15. Third-party services and links
The Service links to third-party sites and depends on third-party services (Apple, our host, our data providers, our AI provider). We don't control them and aren't responsible for their content, availability, or practices. Your use of a third-party service is governed by that party's terms, and you agree to comply with any third-party terms that apply to your use of the Service.
16. Apple
This section is required for apps distributed through the App Store, and it applies to the iOS app.
- These Terms are between you and Kwabu LLC only, not Apple. Kwabu, not Apple, is solely responsible for the app and its content.
- License scope. Your license to use the app is the one in §2 — limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. Kwabu is solely responsible for any maintenance and support for the app. Apple has no obligation whatsoever to furnish any maintenance or support services for it.
- Warranty. Kwabu is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Kwabu's sole responsibility.
- Product claims. Kwabu, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including: (a) product liability claims; (b) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of the HealthKit and HomeKit frameworks (which this app does not use).
- Intellectual property claims. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Kwabu, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer name and address. Questions, complaints, or claims about the app should go to: Kwabu LLC, support@cattlemarketpulse.com.
- Third-party terms. You must comply with applicable third-party terms of agreement when using the app.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
17. Termination
You can stop using the Service at any time — delete the app, and cancel any subscription through Apple.
We may suspend or terminate your access if you materially breach these Terms (especially §3), if we're required to by law, or if we discontinue the Service. If we terminate your access for reasons other than your breach while you have time remaining on a paid subscription, contact us and we'll work with you on a fair outcome — but only Apple can actually issue a refund.
Sections 4 (feedback), 10, 12, 13, 14, 18, 19, 20, 21, and 22 survive termination.
18. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, KWABU LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WITHOUT LIMITING THAT, WE DO NOT WARRANT THAT THE DATA, CALCULATIONS, INSIGHTS, OR AI-GENERATED ANSWERS IN THE SERVICE ARE ACCURATE, COMPLETE, CURRENT, OR ERROR-FREE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME.
No advice or information you get from us, whether spoken or written, creates any warranty not expressly stated here.
Some jurisdictions don't allow the exclusion of certain warranties, so some of the above may not apply to you.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- KWABU LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST BUSINESS, LOST OR MISSED MARKETING OPPORTUNITIES, TRADING OR HEDGING LOSSES, INSURANCE COVERAGE YOU DID OR DIDN'T BUY, OR LOST OR CORRUPTED DATA, arising out of or relating to the Service — even if we've been advised such damages are possible.
- OUR TOTAL LIABILITY for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) fifty U.S. dollars ($50).
These limits apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and are a fundamental part of the bargain between us — the Service is offered at the price it is because of them.
Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.
20. Indemnification
You'll defend, indemnify, and hold harmless Kwabu LLC and its members, officers, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service, your violation of these Terms or of any law, your infringement of anyone's rights, or content you enter into the Service. This doesn't apply to ordinary consumer use of the Service as intended.
21. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Talk to us first. If something goes wrong, email support@cattlemarketpulse.com and give us 30 days to sort it out. Most problems are a bug or a misunderstanding, and we'd rather fix it than argue about it.
If we can't resolve it informally, you and Kwabu agree that any dispute will be brought exclusively in the state or federal courts located in Texas, and we each consent to the personal jurisdiction of those courts. If you're a consumer, this doesn't take away any right you have to bring a claim in your local small-claims court, or any protection you have under the mandatory consumer laws of the place you live.
22. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and Kwabu about the Service, replacing anything said before.
- Severability. If a court finds part of these Terms unenforceable, the rest stays in force and that part is limited to the minimum extent necessary.
- No waiver. If we don't enforce something right away, we haven't given up the right to enforce it later.
- Assignment. You can't assign these Terms without our written consent. We may assign them to a successor in connection with a merger, acquisition, or sale of our assets.
- Force majeure. We're not liable for failures caused by things outside our reasonable control.
- Changes to these Terms. We may update these Terms. We'll change the effective date at the top and post the new version at this URL. If a change is material, we'll give reasonable notice before it takes effect — continuing to use the Service after that means you accept it. If you don't accept, stop using the Service and cancel any subscription.
